Nebraska, Kansas, Colorado, and Arizona for their delivery-related and other work-related expenses, a new class action lawsuit alleges.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Plaintiff Michael Holder claims delivery drivers at Bacus-owned Jimmy John\u2019s sandwich shop franchise locations are not paid \u201cthe legally mandated minimum wage for all hours worked.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Holder argues the Bacus Jimmy John\u2019s locations do not reimburse their delivery drivers \u201cat a reasonable approximation of the drivers\u2019 vehicle expenses,\u201d despite requiring them to \u201cmaintain and pay for operable, safe, and legally compliant automobiles.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cBy failing to adequately reimburse for their delivery drivers\u2019 vehicle expenses, the Bacus Jimmy John\u2019s stores have unlawfully withheld and\/or diverted wages from the delivery drivers,\u201d the Jimmy John\u2019s class action states.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Holder wants to represent a nationwide class of all current and former delivery drivers employed at a Bacus Jimmy John\u2019s store that was owned, operated and controlled by the defendants during the last three years, and a Nebraska class during the last four years.\u00a0<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Jimmy John\u2019s benefits from having delivery drivers use personal vehicles for work, says class action<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Holder argues Bacus-owned Jimmy John\u2019s locations also \u201creceived a benefit\u201d by having delivery drivers use their own vehicles to complete deliveries, allowing the franchisees to \u201cnot have to incur the expense themselves.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cBy requiring delivery drivers to provide the cars used to make deliveries for their business, Defendants avoid substantial risk and insurance costs that they would otherwise be required to cover,\u201d the Jimmy John\u2019s class action states.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Holder claims the Bacus Jimmy John\u2019s franchisees are guilty of unjust enrichment and violating the <\/span><a target=\"_blank\" href=\"https:\/\/www.dol.gov\/agencies\/whd\/flsa\" rel=\"noopener\"><b>Fair Labor Standards Act<\/b><\/a><span style=\"font-weight: 400;\">, the <\/span><a target=\"_blank\" href=\"https:\/\/dol.nebraska.gov\/LaborStandards\/FAQ\/General\" rel=\"noopener\"><b>Nebraska Wage and Hour Act<\/b><\/a><span style=\"font-weight: 400;\">, and the <\/span><a target=\"_blank\" href=\"https:\/\/nebraskalegislature.gov\/laws\/statutes.php?statute=48-1228\" rel=\"noopener\"><b>Nebraska Wage Payment and Collection Act<\/b><\/a><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Plaintiff is demanding a jury trial and requesting declaratory relief along with an award of damages, including, among other things, unpaid wages, liquidated damages, and unreimbursed expenses.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In another case involving a sandwich restaurant, a lawsuit was filed against Seven
